August 2011 Newsletter

From the President:
Howdy to all,
I just spoke with a friend of mine in Biloxi, Ms and wonderful news it is 75 and raining and she is cold. Doesn't that give you hope for a break here. I know there is a heat wave on the way and I intend to spend it quilting away.
I can still taste the most wonderful ice cream that Margaret made for our meeting. Our July meeting was such fun I am looking forward to August and more demonstrations.
See you all in August and until then keep quilting away.

Programs

Thanks to Lynn Lucas, Helen Brown and Kathy Allison for their help with demos in July!
August is Covered Dish supper and several demos for your entertainment. Hand applique techniques and how to set up a design on your blocks are part of one demo. Disappearing 9-patch designs will be another demo. Insetting a circle will be the third.

September is the Silent Auction. Bring your items to sell. It does not have to be quilt related, it can be handmade or something you do not need. Sell that fabric you bought and never used and help out the guild. We will be there at 6PM to begin setting things up.
October is a trunk show from ATW, a talented group of artists from the Low country. They will be starting the show at 7, before the meeting, so be there early!
November the Challenge quilts are due. While votes are being totaled, we will have a trunk show of star quilts and information about our next library show.
December will be our annual Christmas party and stocking sew-in. Rumor is that games might be played. Stay tuned.

Love Goddess’ Report on Love Quilt Programs

My house is now free of all charity quilts!!!!!! Delivered to Childrens' Garden and Breast Cancer Center all quilts I had on hand.
We gave out the last Epworth quilt to be quilted at the July meeting. You all should be proud of the hard and loving work the guild has accomplished this year.
We received one quilt for the Childrens' Garden -- the first of our June worskshop quilts to come back. If you would like a kit from the workshop contact Beth or me and we will get one for you.
Let's again remember the Childrens' Garden kids with freezable popcicles in August.

Quilt Collector Obituary/Collection info from The NY Times
http://www.nytimes.com/2011/07/17/arts/ardis-butler-james-quilt-collector-dies-at-85.html
Mrs. James had long been a fabric addict, an affliction most commonly seen in women and not universally understood by men. She was fortunate: Once, offered a fur coat by her husband, she chose a sewing machine instead and he did not demur. (A friend of hers, by contrast, had to spirit her fabric purchases home in a grocery bag, concealed beneath a mound of potCopyright Q & A for Quilters
Do you have questions about how copyright law applies to you? Do you wonder if you can enter your recent quilt in the guild show? Or are you curious whether or not you can sell the quilts you make from patterns? There are plenty of quilters who share your concerns and this article will address some frequently asked questions - but first, a brief overview of copyright law.
The basic rule of copyright is that only the copyright holder may do any of the following:
Make copies of the original design in any medium. Taking a photograph of a quilt is even considered making a copy.
Make derivative works. Derivative works are those that include some elements or aspects of the original design.
Distribute copies of the work to the public by selling, lending, leasing or otherwise transfer of ownership.
Display the copyrighted work or copies of it publicly. Public display is any showing beyond close family and friends.
Of course there are exceptions to these restrictions. Fair use is one area of exception that includes comment, criticism, news reporting, public school and university teaching, scholarship and research. This set of exceptions allows newspapers and magazines to show and discuss work, or for a student or researcher to make copies or quote from a protected source.
The exception that is of most interest to quilters and other visual artists is known as the "first sale doctrine." This is a rule of law that states that once a copyright holder sells or otherwise disposes of a copy of a protected work, the new owner of that copy may display, distribute, sell or pass ownership to another without the permission of the original designer. The only thing the new owner may not do is make a copy of the copy. The key to this exception is that the new owner must have legally obtained the copy.
Finally, and importantly, the holder of the copyright may give his or her permission for another to undertake any of their exclusive rights, including permission to make a copy. Permission is usually required to be in writing, but there is one exception to that: a non-exclusive permission or license. This type of permission may be oral or implied from the circumstances.
This is all very technical legal information. But as we go through the following questions - posed by quilters - and their answers, the meaning of these rules and exceptions will hopefully become clear.
1. How do I copyright my work (i.e. become a copyright holder)?
A copyright comes into existence as soon as an original design is made in a tangible form. That would include a drawing or computer design as well as the actual quilt. There are reasons for registering a design with the U.S. copyright office. If you plan to sell patterns and want to establish that the design is yours, registration is a good idea. The information and forms required are online at: www.copyright.gov.
2. How do I know if quilts I have design are really my originals?
Under copyright law, original means that it comes from your own creative processes without copying from the work of another. Strange as it may seem, two people may come up with the same design and each may be an original a protected by copyright. As long as the design is from your independent work, it is original.
3. If I make a quilt from a pattern, magazine or book, can I sell or donate that quilt?
As long as you are using a published pattern that you have purchased, the quilt you make from the pattern is a legal copy and is yours to sell, donate or give away. This is the right provided by the first sale doctrine. What you cannot do is copy or photocopy the pattern itself.
4. Can I sell multiple items made from a copyrighted pattern?
This is not an issue that I have found addressed by any court. In my opinion, I believe that the implied permission granted you by purchasing the pattern is limited to a "reasonable" number of copies. A designer expects you to make one or two copies. If you make 50 to sell, you are undercutting their opportunity to benefit from their design. I believe you should get permission from the copyright holder before making a large number of copies or using their design for a fund raising quilt. The commercial nature of these activities may take them out of the implied permission to make copies.
5. If I want to make multiple copies for sale, can I pay a royalty to the designer? If so, how?
You should contact the designer and ask permission to make the copies. If the designer requests a royalty payment, you can negotiate the amount and make arrangement for sending payment.
6. Can I copy antique quilt designs?
Yes. Copyrights are time limited. How long a copyright lasts depends on when the design was created. Right now, copyrights last for the life of the designer plus 70 years. But the law prior to 1978 was that a copyright lasted for 28 years and then could be renewed for 28 years. The old classic designs are in the public domain and may be used by anyone for any purpose.
7. I get inspiration from artwork (paintings, folk art, etc.) Do I need to credit the artist for my needlework design?
It is always a good idea to give credit when your quilt has been inspired by the art of another. It's also good manners to credit a teacher when the work is made from a class or acknowledge the designer if a quilt is made from a pattern. There is no law that requires this however.
8. I use coloring books for my appliqué quilts with such designs as the Pink Panther, Mickey Mouse, etc. Is there a problem with this?
Yes. These characters are protected by copyright and, in some cases, by trademark. Using those images without permission violates copyright. Buying a coloring book does not extend permission to make copies.
9. If a block is from the 1800's (Nine Patch, Shoofly, Crazy patch), can a magazine claim a copyright and prevent others from using the pattern they print?
No. Once a design is in the public domain (out of copyright) it cannot be copyrighted again. Magazines claim copyright in the pages of their issues. They won't prevent you from making a copy of an antique block. They can prevent you from copying the pages of their magazine.
10. Can I sell a quilt that includes a licensed fabric? (Disney, John Deere tractors, sports logos)
This is a difficult question. Under the first sale doctrine, once you buy the fabric you can sell it, cut it up, do with it what you wish. Also, the copyright holder would expect that the fabric would be used to make an item. Arguably you should then be able to sell the item you make from the fabric. In the few cases with a similar issue, courts have come to conflicting decisions. Companies who own these images have attempted to prevent commercial use of their fabrics. I don't know how other courts might decide.
These are only a few of the questions that quilters have about copyright law. Not all of the questions have a definitive answer. But it's good to keep asking. And when in doubt, ask permission.

July 2011 Newsletter

From the President:

Howdy Ladies,
Hope everyone is having a wonderful summer. It sure has arrived with a big hello from the heat. I have vowed to embrace it after the winter that we had. I am looking forward to our July meeting with ice cream. I heard rumor that it will be homemade this year, so my taste buds are watering. I know that Lynn Buske has some exciting things planned for us this summer also.
We are having company so I will be doing the tourist thing. We all need to do the tourist thing in our own world. Aside from being tons of fun, we get to see our city and state in a whole new light. We will have a blast here.
I have been quilting away as I hope you have also. See you soon! I am off to make peach pie!

Love Goddess’ Report on Love Quilt Programs

We had a wonderful night last month with the preparing of quilt kits. Fifteen kits were prepared with fabric and batting. Eleven went home with members to be pieced and quilted. I have several kits which I will bring to the July meeting. I also have a couple of quilts that need to be quilted. I will also bring those in July.
I received the last Epworth quilt on Friday so will make a run to the Children's Home and deliver these love quilts for the senior girls going on to college.
We need to make a decision on Epworth as one of the continuing recipients of Devine Guild charities.
Remember quilts for Breast Cancer Center and Children's Garden. Bring popsicles (the to-be-frozen kind) for Children's Garden.

I want to thank you all for the lovely quilt I was given last month. Being Love Goddess has been a most rewarding part of this Guild's work. I will treasure it always. I'll also bring it for Show 'N Tell in July.

Joplin Tornado Assistance

Ladies,

Not sure if you have seen the below postings to re-guild Joplin, MO. I've already sent two boxes and am filling up number three. Other guild members might be interested in sending things. I would even donate a sewing machine if I knew someone could drive it there. ---Stephanie

“From now until the end of July and probably beyond - we'd like to gather all quilters for Operation Re-Guild Joplin. After discussing the devastation from the tornado in Joplin with Kat, over at The Quilt Shoppe, and both being in tears, we decided we needed to call in all the forces and reorganize our efforts!
We have already begun to collect donations for baby items, quilts, pillowcases, stuffed toys and then realized that the guild and quilters who lost their source of supplies and place to meet and sew are in need of supplies. Lets all help rebuild these quilters’ lives by allowing them to continue with their passion of quilting during this most difficult time. We're asking for donations of books, patterns, fabric, notions, rulers - anything you can imagine a quilter needing. Thanks for all the donations, so far. We can do this! We ARE Quilters!

You can bring your donations into Stitchin' Heaven & The Quilt Asylum or mail them into:

Upcoming Events
Artful Lives: Molas of the Kuna April 9 – June 25, 2011 McKissick Museum Second Floor
Artful Lives: Molas of the Kuna explores the history and contemporary textile creations of the Kuna women of coastal Panama. In the mid 19th century, Kuna women started experimenting with ways to transfer body painting designs onto cloth. These women have developed a distinctive style unlike that of any other folk culture. They use their clothing as a mode of personal expression, taking great care with decisions about the combinations of skirts and scarves as well as with the creation of their mola blouses. This attention to detail along with their expert stitchery has earned this craft recognition around the world. Today, the sale of these textile arts is the second most important income source to the Kuna and examples are collected by museums around the world. A must see exhibit if you are a quilter - lots of appliqué and reverse appliqué.
The exhibition contains dozens of examples of both complete Mola blouses and individual panels. Drawn from the extensive collection of Jean E. Kanes, most have never been exhibited before.
